Information SHF Collects
- SHF collects personal information when you register an account with SHF, when you use SHF’s services, such as the Board Registry, and when you visit SHF web pages.
- When you set up an account on the Web site SHF asks for personal information such as your name, address, email address, birth date, gender, zip code, occupation, industry, and personal interests. Once you register with SHF and sign in to our services, you are no longer anonymous to us.
- SHF collects information about your transactions with us and services that we offer.

Welcome to The Surfing Heritage Foundation’s (“SHF”) web site (the “Web site”). Please read the terms and conditions of this user agreement (“User Agreement”) for using SHF’s Web site. By using the Web site and the information and services available through the Web site, including, but not limited to, the Board Registry, you agree to follow and be bound by this User Agreement. If you do not agree to the terms and conditions set forth in this User Agreement, do not use the Web site.SHF owns the Web site and reserves the right, at its discretion, to modify the terms and conditions of the User Agreement at any time and any such modification will be effective immediately upon posting the modification. You should check these terms and conditions periodically for modifications. If you use the Web site after we post modifications to the Web site, then you will be bound by such modifications.
This User Agreement is in addition to any other agreements between you and SHF, and any other agreements that govern your use of products, services, content, tools and information available on the Web site.

Indemnity
You agree to indemnify and hold SHF and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of content you submit, post, transmit or otherwise make available through the Web site, your use of the services provided on the Web site, including the Board Registry, your connection to the Web site, your violation of the this User Agreement, or your violation of any rights of another.General Information
Entire Agreement. This User Agreement constitutes the entire agreement between you and SHF and governs your use of the Web site, superseding any prior agreements between you and SHF with respect to the Web site. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other SHF services, affiliate services, third-party content or third-party software.Choice of Law and Forum. This User Agreement and the relationship between you and SHF shall be governed by the laws of the State of California without regard to its conflict of law provisions. You and SHF agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Orange, California.
Waiver and Severability of Terms. The failure of SHF to exercise or enforce any right or provision of this User Agreement shall not constitute a waiver of such right or provision. If any provision of this User Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of this User Agreement remain in full force and effect.
No Right of Survivorship and Non-Transferability. You agree that your SHF account is non-transferable and any rights to your SHF or contents within your account terminate upon your death. Upon receipt of a copy of a death certificate, your account may be terminated and all contents therein permanently deleted.
Statute of Limitations. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Web site or this User Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.
Section Titles. The section titles in this User Agreement are for convenience only and have no legal or contractual effect.
Arbitration of Disputes. Any dispute relating in any way to your visit to the Web site or its content shall be submitted to confidential arbitration in Orange County, California, except that, to the extent you have in any manner violated or threatened to violate SHF’s intellectual property rights, SHF may seek injunctive or other appropriate relief in any state or federal court in the state of California, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this User Agreement shall be joined to an arbitration involving any other party subject to this User Agreement, whether through class arbitration proceedings or otherwise.
